The European Trade Union Institute (ETUI) has published a report entitled “The influence of the Court of Justice on EU health and safety legislation – an analysis of the case law (1989 – 2022)”. It was produced by Aude Cefaliello, Senior Researcher at the European Trade Union Institute (ETUI) and Ninon Henry, a lawyer at the Brussels Bar specialising in labour and social security law.
This report provides an overview of proceedings before the Court of Justice of the European Union relating to directives on health and safety at work between 1989 and 2022. In particular, it aims to highlight certain trends that may be useful in developing a litigation strategy in the field of health and safety.
Specifically with regard to accidents at work and occupational illnesses, the report looks back at the scope of Case C-127/05 (United Kingdom v Commission) of 2007, on the extent of employer liability for health and safety at work in the European Union.
