From 9 to 23 January 2026, the Spanish Ministry of Labor and Social Economy held a public consultation with a view to reforming Law 31/1995 on occupational risk prevention and Royal Decree 39/1997, which regulates prevention services.


Companies, prevention services, professionals, trade unions, and specialized entities were invited to actively participate in this consultation, the aim of which was to find ways to reduce the number of workplace accidents while promoting prevention and safer and healthier working environments.

In addition to this objective, there is a desire to reform these two regulatory texts (dating from the 1990s) so that they respond more effectively to the realities of today’s world of work, marked by digitalization, teleworking, climate change, and an aging workforce.


In line with the Spanish Strategy for Safety and Health at Work 2023-2027, the Spanish Ministry states that this reform should, in particular, make it possible to:

  • raise awareness of emerging risks, particularly psychosocial, climate-related, and those linked to digitalization and digital disconnection;
  • integrate gender and generational diversity into preventive management;
  • strengthen protection during pregnancy and breastfeeding;
  • create regional prevention officers, with a particular impact on companies without legal representation, especially SMEs;
  • strengthen the protection of self-employed workers in competitive commercial situations.
