The case concerned an employee in Romania who had asked his employer to pay for his glasses, arguing that screen work had caused a serious deterioration in his eyesight. The employer refused and the case was referred to the CJEU.

Under Directive 90/270/EEC on the minimum safety and health requirements for work with display screen equipment, the Court ruled in December 2022 that :

  • “Special corrective devices” include eyeglasses specifically intended to correct and prevent visual disorders in connection with work involving display screen equipment and are not limited to devices used exclusively in the occupational context.
  • The employer’s obligation to provide the workers concerned with a special corrective device may be satisfied either by the direct provision of the device by the employer or by the reimbursement of the necessary expenses incurred by the worker, but not by the payment of a general wage premium to the worker.

BELGIUM: Case law on PSR since 2016

The Federal Public Service (FPS) Employment, Labour and Social Dialogue has compiled a collection of case law on psychosocial risks at work (PSR) from the labour courts from 2016 to 2023. The first collection covered the period from 2003 to 2010.
